Graeme Allen Barry says he was abused as a child - but a judge says that's no excuse for indecently assaulting two young boys. Barry, 44, appeared in Rotorua District Court yesterday before Judge James Weir for sentencing on two charges of indecent assault. Judge Weir jailed him for four years on the indecent assault charges.
Barry abused one of his victims, aged 7, six times between March 1, 2003 and May 19, 2005 at Te Puke. The other was aged 3 when Barry abused him between January 1, 2006 and June 30, 2006, at Rotorua. Barry was also sentenced on one count of theft, another of receiving stolen property, one of possession of drug paraphernalia and 12 of using a former boss' fuel card to obtain more than $5800 worth of fuel. Judge Weir noted the "significant" effect Barry's offending had on the two boys he admitted abusing. The older victim, now 12, was "terrified" and started using "sexualised" play with other children while the younger victim had not forgotten what had happened, Judge Weir said.
"These children have been harmed by your sexual depravation. It was clearly a breach of trust. These children were particularly vulnerable because of their young age," he said. A probation officer's report and Barry's lawyer Peter Birk noted he was a victim of sexual assaults as a child. This was no excuse, Judge Weir said. "I have some sympathy for that but you have to realise you are responsible for your own actions," he said.Using a starting point of three years' imprisonment, Judge Weir sentenced Barry to two years and eight months' imprisonment on the two indecent assault charges. The defendant in this article is not Graham Barry, 50, of Rotorua's Graham Barry Builders Ltd.
