A schoolboy who raped a girl at a party has been jailed for two years for the "utterly stupid" attack.Shaun David Beattie, 17, was still at school when he raped the 15- year-old girl on a trampoline a year ago during a party at his house. His victim later needed a blood transfusion because she had lost so much blood after the attack.
Justice Hammond said: "It's an utterly stupid, one-off kind of offence .... my view is that he is unlikely to reoffend." Beattie, of Otorohanga, was sentenced in the High Court at Hamilton yesterday. A jury found him guilty of one count of rape after a trial last week. Justice Hammond said he had no alternative but to send Beattie to prison, though he would have been sentenced to at least eight years' prison if he had been an adult. Beattie and the girl had left the party after midnight and walked away from the house. He tried to fondle her breasts but she refused.
He pushed her down on to the trampoline and raped her. On the way back to the party she had to lie down because she did not feel well and had lost a lot of blood. Beattie left her to go back to the party. She made her way back to the party and was taken to Waikato Hospital with low blood pressure and needed a transfusion.
Justice Hammond said the victim's injuries had healed well and she felt vindicated by the jury's decision, though she was traumatised by the trial. Defence counsel Roger Laybourn said there was no lasting harm to the victim. He said it was the combination of young passion, too much alcohol and not enough adult supervision.Mr Laybourn said Beattie felt as though his life had been ruined. Crown solicitor Quentin Almao said an aggravating feature of the attack was the injuries to the victim, which could not be minimised.
