Gavin James Biggs
A sex offender who led an otherwise "blameless" life was sent to prison for five years and four months yesterday.
Gavin James Biggs, 55, freezing worker, of Temuka appeared in the High Court at Timaru before Justice Chisholm for sentencing on 14 counts of sexual offending.
The charges included rape, attempted rape, indecent assault (nine charges), doing an indecent act, and inducing a girl to do an indecent act (two charges).
The charges related to two different complainants, with the offences taking place in various locations around South Canterbury, over a period of four years from 1979.
The victims were then aged 10 to 13, and 9 to 11. Biggs was aged between 26 and 30.
Counsel Wayne van Vuuren said apart from this offending, Biggs had led a blameless life without much more than a parking ticket.
He said since 1984, Biggs had shown he was an upstanding, hardworking, family man.
A pre-sentence report showed Biggs had an intellectual disability and Mr van Vuuren said it was likely he had had the disability from the age of 18.
He said that Biggs' risk of further offending was low, and he had a fear of how he was going to be treated in jail.
For the Crown, Andrew McRae said there should be a starting point of nine years because of the significant duration of the offending, the number of victims, and the fact that the charges of rape and attempted rape were representative.
As the victims had been prepared to give evidence, they had also had to relive the incidents. While he said the breach of trust was not father and daughter type offending, there still was a breach.
Justice Chisholm said the offending had a huge impact on the two victims and it had affected their whole lives.
It had compromised their ability to trust others and they had to endure the awful nightmare of wondering if they would not be believed.
"The effects of the offences will be with them for the rest of their lives.
"The tragedy is, apart from this offending over around four years, you've led an absolutely blameless life."
In sentencing, Justice Chisholm took into account the young age of the two victims, their suffering, the elements of breach of trust and premeditation.
He made a discount for Biggs' guilty plea, good record and intellectual limitations.
Biggs was sentenced to five years and four months imprisonment for rape. For the attempted rape, he was sentenced to 2 1/2 years and on the other charges, 18 months each.
All sentences are to be served concurrently.
