Taking the law into their own hands got two men some jail time yesterday. Kevin Andrew Shaw (37) and Daniel William Bloomfield (28) were sentenced at the Hawera District Court for a violent home invasion.
Crown prosecutor Tim Walls said the men went to an Opunake address shortly after midnight on November 6 where the victim, his partner and four children were asleep. Shaw went to the victim's bedroom and threatened him with a 70cm metal bar while accusing him of a burglary. Bloomfield waited in the hallway and entered once the victim's partner had left the room. He then jumped on the bed and began punching the victim while Shaw began hitting him with the metal bar. The pair left the address, but realised they had left their car keys inside.
When the pair returned to the house Bloomfield struck the victim again. They were arrested by police before they had an opportunity to leave. Both men were charged with injuring with intent. Shaw was charged with aggravated burglary and Bloomfield was charged with a being a party to the burglary.
Defence counsel for Bloomfield, Barry Henderson said his client was not aware Shaw had taken the weapon to the address that night. Judge Allan Roberts said Shaw was armed and had secured additional manpower before carrying out the attack. "There were children in the house. The consequences for them are incomprehensible. They were at home where they were free from the pressures of the outside world and you shattered that."
Shaw was sentenced to five and-a-half years in prison. Judge Roberts said Bloomfield was foolish to become involved and sentenced him to four years and two months in jail.
