The Court of Appeal has quashed a man's convictions for sexual violation and attempted sexual violation of a boy because a judge erred in his instructions to a jury. Andrew Robert Cassidy was convicted after a High Court trial on three counts of indecent assault, one of committing an indecent act, three of attempted sexual violation and six of sexual violation, all relating to a boy aged between 12 and 16. Cassidy appealed all convictions and in a decision released today the Court of Appeal allowed part of his appeal. It said errors were made when he instructed the jury on consent issues.
The convictions on the attempted sexual violation and sexual violation were quashed. Convictions for indecent assault were substituted for four of the sexual violation counts. The existing indecent assault and indecent act counts were not affected by the decision.The court directed that a further hearing be held in the Court of Appeal as soon as possible to determine Cassidy's sentence in light of the partially successful appeal. He will remain in custody in the meantime.
