At around 4 o'clock in the morning the victim was on her way home and walked through Central Park in Wellington and was indecently assaulted by Hassan (a Burundi refuge) after refusing his advances. The victim managed to resist an attempted by Hassan to have sexual intercourse resulting in her being repeatedly kicked and having fallen down a steep bank.
She was then able make an escape and find assistance. Judge Margaret Lee said when sentencing Hassan sad the attack was "every woman's nightmare" and called it a "horrendous" crime. Hassan appealed, arguing his sentence was excessive but for the Court of Appeal, Justice Henry said it was the actions of the victims which prevented the commission of a more serious offence. Hassan's appeal against his sentence was dismissed.
