A man sent to jail for seven years for raping a 15-year-old girl has been warned he is likely to receive preventive detention if he is convicted of a further sexual offence. Adrian Raymond Hogben, 43, admitted one charge of rape and one charge of sexual violation by unlawful sexual connection.
Hogben had picked the girl up in Worcester Street about 11pm on February 28 after she flagged his car down. He took her to a remote spot behind Christchurch Airport and raped her before dropping her back off in town. Counsel Greg Trainor said it was accepted that a prison sentence had to be imposed. He said an aggravating feature of the offending was the girl's age.
Mr Trainor said Hogben maintained he was not aware of the girl's age and that hethought she was a prostitute. He previously had been convicted of indecent assault in 1980 and for unlawful sexual intercourse with a girl under 16 in 1997. Crown prosecutor Brent Stanaway said it was accepted that the girl had been a streetworker at one stage but was not on the night Hogben picked her up.
Justice Young said the girl was frightened she was going to be murdered. He said Hogben was not entitled to have sex with her without her consent and warned him that any further sexual offences were likely to result in a preventive detention sentence.
