Dean Nauru Misileki
On 22 May 2008 the appellant, Mr Misileki, was sentenced by Judge Treston to two and a half years imprisonment on one count of sexual connection with a girl under 16 between 5-9 April 2007 (s 134(1) of the Crimes Act 1961). He pleaded guilty to that count on 10 March 2008.
Over Easter weekend 2007 the complainant, then aged 14, was staying at her aunt’s property. Mr Misileki, then 26, lived at that address. On the Saturday evening, waking her from sleep, he persuaded her to come to his room where he had intercourse with her.
Over the following days and weeks he sent numerous text messages trying to persuade her not to disclose what had occurred. The offence came to light in June 2007. When interviewed, the appellant admitted the facts. The victim impact statement showed that by reason of the matter the complainant left the Auckland area, changed schools and required counselling.
