Richard Chetwyn Parker
Richard Chetwyn Parker, a man of 45, was found guilty after a jury trial in the High Court at Aucldand of attempted rape of a 14-year old girl at the Centrepoint Community at Albany between September and December 1978 and was sentenced to 4 years 5 months' imprisonment after allowing for one month spent in remand custody.
The girl's mother and father had separated and she had been living with her nit and the appellant at the latter's house for about a year and had moved with them into the Centrepoint community shortly before this offence. Up until then she said she had been a virgin. In her evidence she described the appellant climbing into her bed next to a caravan in which he slept with her mother. Re took off his clothes and lay on top of her and tried to put his penis inside her but she objected and said it was too big, whereupon he stopped and went away. She then went to another room to sleep and said the appellant tried later to get into her bed there but was told by someone else to stop. The complainant said she was upset, especially as she knew the appellant was her mother's man. The matter was reported to her mother. In keeping with what appears to have been the community's approach to sexual activities, she saw fit to do nothing about it, although she said she was upset and angry. In her evidence she said that the appellant seamed unconcerned about his conduct.
