In the Auckland High Court, Justice Raynor Asher said Taupau continued to deny his offending, had displayed no remorse or contrition. He was satisfied Taupau would pose a significant danger to the community if he was released. The judge said if he was to impose a finite sentence it would have been one of 14 years 6 months with a 8 year 6 month non-parole period.

A man jailed in 1993 for raping and indecently assaulting a young girl in 1985 has won an appeal against a deportation order. Sauiluma Taupau was not tried till July 1993. The Deportation Review Tribunal said the victim had not complained "out of fear and other psychological disturbances" for about seven years. A victim impact report showed that severe traumatic effects had affected the girl for at least eight years after she was violated when she was 10 and Taupau was 18. Taupau, who was born in Western Samoa, arrived in New Zealand in late 1984, aged 18.
His temporary permit was extended till the end of 1985 and the offences happened over that time while the girl was living in his household. He went back to Samoa and returned to New Zealand in 1987, establishing an excellent work record, marrying a Samoan woman who had New Zealand citizenship and distinguishing himself as a youth leader in his church. They had a baby in 1991 and lawyer Olinda Woodroffe said deportation would be unduly harsh. The tribunal said it was confident Taupau would not reoffend.
However Taupau did reoffend, and was sentenced to Preventative Detention in May 2008 after being chagred with sexual violation by rape x 4. These charges related to sexual offending between 1999 and 2005 against another niece.
