A promising rugby player has been left maimed, epileptic and facing an uncertain future after a bashing with a golf club. Rory Manuel and Dwaine Tonihi were each jailed for six years yesterday by Christchurch District Court Judge Colin Doherty on a charge of causing grievous bodily harm with intent, arising from an altercation at a party which ended in the victim receiving a fractured skull after being clubbed from behind. "It was a premeditated and cowardly act where the victim was hit from behind in circumstances where he could have had no inkling of what was coming," Judge Doherty said.
Manuel, 20, had admitted the charge, and one of assault with a weapon. Tonihi, 23, was convicted on the same charge after a jury trial and also on a charge of assaulting a female. It was apparent multiple blows had been rained on the victim, even though someone had tried to protect him, the judge said. After an altercation with another group at the party, both had driven around the corner, armed themselves with a golf club, and come back looking for trouble."I've got no doubt you took the weapon intending to use it to deal to the victim and his mates," Judge Doherty said.
Tonihi had pushed a woman out of the way and punched the victim. Manuel then struck the man from behind with the club, continuing to rain blows on him. He suffered a depressed skull fracture needing surgery, the court was told. The injury caused epileptic episodes and he was on medication to prevent seizures. A promising representative rugby player, he was now unable to play, the judge said. He also suffered financial loss and was unable to work full-time, and his long- term prognosis was uncertain.
