The Nelson Mail. August 15th, 2007
A Nelson man has been sent to jail for a "brazen'' indecent assault with"sexual overtones''.
Ernest Pitoitua Tuiletufuga , 45, appeared in the Nelson District Courtyesterday having previously admitted charges of indecent assault, breachingcommunity work and disorderly behaviour. Defence lawyer Tony Bamford said Tuiletufuga had problems with substance abuse, and lately alcohol. He did not have a clear recollection of events, but accepted they caused some distress.
Judge Tony Zohrab said Tuiletufuga was at the Tahuna Beach Holiday Park onApril 25 and was intoxicated. He approached a 14-year-old boy and asked him what he was doing. The boy became frightened and called out to his mother, who was nearby. She came to her son's aid and Tuiletufuga thrust his hand towards her groin.
On January 11 Tuiletufuga had attended an induction course for a fishingcompany. An 18-year-old female was also on the course, and afterwards hefollowed her down Haven Rd, later trying to kiss her on the lips. Judge Zohrab said Tuiletufuga also poked the woman's breasts with his finger, which "terrified'' her. The judge said he was concerned about the "sexual overtones'' of the "brazen'' offending. He sentenced Tuiletufuga to 18 months in prison, and granted him leave to applyfor home detention. Tuiletufuga must also complete a psychiatric assessment, and drug counsellingand treatment to the satisfaction of his probation officer.
