The Court of Appeal has quashed the 18-month jail term of a 14-year-old youth who attacked a man and left him brain damaged. Adam Anish Chand-Whakaue was sentenced in Rotorua District Court for an April 28, 2005, attack on Graeme Managh. He was one of three charged over the assault. Chand-Whakaue pleaded guilty to assault with intent to injure and was sentenced to 18 months' jail.
However, lawyer Harry Edward appealed the sentence, arguing jail should not have been imposed as Judge Chris McGuire had no reason to believe Chand-Whakaue would not comply with an alternative sentence. The Court of Appeal substituted the original sentence for 200 hours' community work and 18 months' supervision, subject to special conditions including that he not associate with his co-offenders.
