Around midday on 10 June 2007, the male and female victims, together with their son, aged 17 months, were at home in Murupara. The male victim was asleep on a couch in the lounge. The female victim was on the floor with their baby.
The three brothers arrived at the victims’ house and came to a ranch-slider door at the lounge. The female victim opened the door to see what they wanted. As she began to open the door, one of the three brothers pulled it wide open. All three forced their way into the house. Trinity was carrying a baseball bat.
The Akuhata brothers yelled and swore at the male victim as he lay sleeping on the ground. They were under the false impression, from information provided to them earlier in the day, that he had raped their sister. The female victim pleaded with them not to act in this way in front of her young son.
The male victim was beaten while he lay on the couch. Trinity struck him several times around the face and head with the baseball bat. Blaize and Vincent kicked and punched the male victim several times. On one occasion, the young baby began to crawl towards his father, while he was under attack. The female victim tried to grab her son, but was pulled back by one of the brothers. As she tried to get past them to retrieve her son, she was struck on the elbow by a swinging baseball bat.
By the time she reached her partner, he was lying prone on the couch, bleeding profusely from wounds to his head and face. The Akuhata brothers walked out of the house and left in a vehicle.
The male victim was hospitalised for three days as a result of the attack. He received a fractured nose, a cut and bruising to his left eye socket, bleeding and bruising of the kidney, multiple fractures, bruising to his legs and a swollen right ankle. The female victim’s injuries were much less serious, consisting of redness and swelling to her right elbow.
