A 45-year-old man has been jailed for more than two years after forcing a five-year-old boy to touch his genitals while he played in the children's area of a popular Auckland swimming pool.
Paul Christopher Keith Neil, 45, has been sentenced after admitting committing an indecent act on the boy on March 1 this year at Parnell Baths.
Neil sat in the fountain pool in the children's area and watched and chatted with children. He became aroused by looking at teenage girls and called over the five-year-old boy, who'd become separated from his family.
Neil put the boy's hand on his exposed and erect penis before the victim pulled away and ran to tell his father.
The father alerted pool staff and the police were called.
In his victim impact statement, the father said his son didn't appear to have suffered significant and ongoing emotional harm, but as a father, he was now more aware of danger presented by strangers.
Neil got out of jail in 2010 after spending 14 years behind bars, and was subject to a preventative detention sentence. He was also banned from going to pools under his strict parole conditions for three convictions for sexual assault on a female under 12.
Justice Tim Brewer said the act was on the less serious side of the spectrum but had occurred in a public place.
"Even if the offending was not specifically premeditated, you went to the children's area deliberately and deliberately put yourself in a high risk situation."
Justice Brewer sentenced him to two years and two months in prison with a minimum period of 17 months, but pointed out that there'd still be adequate protection for society as Neil was already subject to preventative detention.
