The facts of the first offence are that you were sleeping in the same room as the complainant. During the night you twice reached under his blankets and fondled his genitals, on the outside of his clothing. He pushed your hand away, and the offending ended there.
The facts of the second offence are that during the night, on at least three occasions, you lay next to the complainant, put your hand down his pants and fondled his penis with your hand. On one such occasion you took his pants off. Whenever you were disturbed by noises in the house, you returned to your place on the couch and then went back to the complainant when you felt it was safe to do so. The complainant was terrified and did not know what to do.
You are currently resident in the Te Piriti Unit of Auckland Prison for sexual offenders, having been sentenced to nine years imprisonment on 30 April 2003 with a minimum period of five years imprisonment. It was as a result of therapy at the prison that you arranged to contact the Police and disclose the offending that I have just outlined. You explained that you wanted to help your victims, who have confirmed the facts as outlined. I acknowledge that your decision to disclose these offences is an important point in your favour.
Your list of previous convictions begins in 1988. There are some 31 in all, including convictions relating to cannabis, burglary, other offences of dishonesty, common assault, and driving offences. Your history of convictions for sexual offending begins with the offences for which you were convicted on 30 April 2003.
Facts of the previous sexual offending
It is convenient to outline at this point the circumstances of that offending. The offences occurred between 1999 and 2000. There was one charge of sexual violation of RH, and three of indecently assaulting RH, BH, and JK, all of whom were boys aged less than 16. There were also charges of supplying drugs to the victims. RH was a street child whom you befriended, making a pretext of taking him under your wing, and plying him with cannabis. Justice Harrison found that you did so to maintain his friendship and to groom him for sexual offending, which included anal intercourse. It had a severe and enduring effect upon him. The offending against BH also involved fondling his genitals when he was high on petrol, and you supplied him with cannabis. The circumstances of the offending against the third complainant were similar; he was plied with alcohol and cannabis and again you attempted to indecently assault him. Fortunately for him, he resisted. Each of the victims was vulnerable, and there was a degree of violence with the first victim. You pleaded guilty, albeit late.
